The Bitpie Wallet Team (hereinafter referred to as “Bitpie” or “We”). This User Service Agreement (hereinafter referred to as “this Agreement”) is jointly signed by you (the user) and the Bitpie Wallet Team.
Before you register, use the related websites, applications, and accept our services, please read this Agreement carefully. Your download of the Bitpie software and the creation or import of a wallet shall be deemed as full reading and acceptance of all the terms of this Agreement, which will immediately take effect and be binding on both parties.
This Agreement may be updated by the Bitpie Wallet Team at any time. The modified Agreement will take effect immediately once it is published, without further notice. If you do not accept the modified terms after the Bitpie Wallet Team publishes the changes to the Agreement, please stop using Bitpie immediately. Your continued use of Bitpie will be considered as acceptance of the modified Agreement.
【Blockchain】: A chain-like data structure combining data blocks in a sequential way, and a distributed ledger that is unalterable and unfalsifiable through cryptography. It uses a block chain data structure to verify and store data, distributed nodes and consensus algorithms to generate and update data, cryptography to ensure the security of data transmission and access, and smart contracts composed of automated script codes to program and operate data, representing a new distributed infrastructure and computational paradigm.
【Blockchain Assets or Blockchain Digital Assets】: Numbers in cryptographic accounts existing in blockchain data, which are considered as digital assets of the legitimate owner of the account, including but not limited to Bitcoin (Bitcoin), Ethereum (Ethereum), EOS, Litecoin (Litecoin), etc.
【Bitpie or Bitpie Wallet】: The software platform/website/mobile app client developed, operated, managed, and legitimately owned by the Bitpie Wallet Team, providing services like blockchain asset local wallets, known in Chinese as ‘Bitpie’, with the domain name bitpie.com, and available on Android and iOS systems. Bitpie Wallet Team provides users with local management services and transaction accelerator services for blockchain digital assets through this software. In this Agreement, ‘Bitpie’ refers to both the software and the Bitpie Wallet Team.
【HD Wallet】: Hierarchical Deterministic (HD) Wallet, a software tool used to store blockchain assets, where the key of the HD wallet is controlled by the user instead of any other party. Bitpie is a local HD wallet, and users need to take on the responsibility of controlling and securing their blockchain assets. Bitpie does not assume the responsibility for the custody of user HD wallet assets or any other related responsibilities.
【Seed Phrase】: Bitpie users create a random number through their own devices (mobile phones, tablets, etc.) to get 12 Chinese characters or 12 English words for the wallet HD account. These 12 Chinese characters or English words are the user’s seed phrase. The creation of the seed phrase is a local behavior on the user end, which can be operated offline and has no relation with the server side, so Bitpie does not have control over the user’s phrase, cannot usurp the user’s wallet asset management, and cannot retrieve the seed phrase for the user. Bitpie complies with BIP32, BIP39, and BIP44 standards, and any other wallets that follow these standards can use the same phrase to recover and manage your blockchain assets.
【User】: A natural person with full civil rights and capacity, or under the guardianship of a guardian with full civil capacity, who voluntarily completes registration, accepts and agrees to all the terms of this Agreement, and uses the services provided by Bitpie for the custody of blockchain assets or other services.
【Personal Information】: Information that is recorded electronically or otherwise that can identify the user’s personal identity alone or in combination with other information, including but not limited to the wallet address, mobile device information, operation record, transaction record of a natural person, but excluding the user’s wallet password, private key, seed phrase.
【Service Charge】: The service fee paid to Bitpie or other collection parties by the user after reaching a blockchain asset transaction using the service provided by Bitpie.
【Miner Fee】: The transaction confirmation fee paid to the blockchain miner node by the user when transferring assets on the blockchain, and the fee is collected by the miner.
【Transaction Accelerator】: The service provided by Bitpie to users to speed up the confirmation speed of transactions on the blockchain.
2.1 Create or Import Wallet: For blockchain assets supported by Bitpie, you can use Bitpie to generate a new wallet or import a previously generated wallet through the seed phrase.
2.2 Send and receive coins. You can use the send and receive feature to manage your blockchain assets, i.e., use private keys for electronic signatures to modify the ledger of the relevant blockchain. Sending is when the sender uses the recipient’s blockchain address to transfer assets. The actual sending and receiving occur on the relevant blockchain system (not the Bitpie platform).
2.3 Transaction Records. We will copy all or part of your transaction records through the blockchain system. Transaction records are based on the records of the respective blockchain system.
2.4 Pause or Revoke. You acknowledge that due to the ‘irrevocable’ nature of blockchain system transactions, we cannot pause or revoke send coin operations for you.
2.5 Transaction Accelerator. A service to speed up the confirmation speed of transactions on the blockchain.
2.6 Other services that Bitpie considers necessary to provide.
3.1 You agree that we provide you with local HD wallet management and other technical services for blockchain digital assets through the ‘Bitpie’ application and related products. To provide you with our services, you need to download the ‘Bitpie’ application on your mobile device, securely store the required seed phrases. If you violate this agreement, we have the right to provide the information you submitted to relevant parties and pursue corresponding legal responsibilities.
3.2 You understand and agree that Bitpie APP is only for mobile applications and you will not install or use it on computer emulators or other device platforms.
3.3 You represent that you are a natural person with full capacity for civil conduct. If you are under 18 years old or a person without civil capacity or with limited civil capacity, please use Bitpie under the guidance of your parents or guardians.
3.4 You promise that all personal information provided to us is true, accurate, and complete. At any time, we have the right to verify the personal information you provided and have the right to refuse to provide services or refuse your use of Bitpie products and services without providing any reasons.
3.5 In order for us to provide the above services to you, you agree to the following commitments:
3.6 You acknowledge and agree that to the extent permitted by law, we will have the right to investigate and take corresponding legal actions against any violations of the above agreements, including initiating legal proceedings. We have the right to report the clues of the above illegal and irregular behaviors and your personal information to judicial or other law enforcement agencies and cooperate with investigations, hearings, prosecutions, etc. conducted by judicial or other law enforcement agencies, depending on the severity of the illegal and irregular behaviors.
3.7 By using the various applications and services of Bitpie products, it means that you accept this agreement and agree to indemnify us for any and all claims, expenses, compensation, losses, debts, and expenses (including but not limited to attorney’s fees and litigation costs) arising from or related to the following:
Bitpie highly values the protection of your personal privacy, and we will collect, use, share and protect your personal information in accordance with this Privacy Policy (hereinafter referred to as “this Policy”). Please carefully read and fully understand this Policy before using Bitpie’s products and services. When you browse, access the Bitpie platform and/or use any product or service of Bitpie, it means that you have agreed to our collection, use, sharing, and protection of your personal information according to this Policy.
4.1 We collect, use, share and protect your personal information, complying with the laws and regulations of the country in which we operate, for the purpose of providing you with Bitpie’s products and services and constantly improving the quality of our products and services. This includes, but is not limited to, supporting our marketing activities related to Bitpie’s products and services, improving the functionality of existing products and services, and developing new products or services.
You authorize us to collect and store the following personal information:
4.2 Protecting user privacy is a basic policy of the company. Without your prior consent, Bitpie will not share or transfer your personal information to any third party, except in the following cases:
4.3 Without disclosing the privacy data of individual users, the company has the right to analyze the entire user database and commercially exploit the user database within the legal range.
5.1 You understand and acknowledge that, due to the lack of comprehensive laws and regulations regarding blockchain assets worldwide, these assets may carry significant risks such as inability to be redeemed, extreme price fluctuations, and unstable technology. We caution you to carefully consider your financial condition and risk preference when deciding whether to hold or dispose of any blockchain asset.
5.2 Bitpie provides services to you as is and as available. Bitpie makes no explicit or implicit guarantees regarding the services and user certification information, including but not limited to the applicability, error-free or omission-free nature, continuity, accuracy, reliability, or suitability for a specific purpose of Bitpie services and user certification information. Furthermore, Bitpie makes no promise or guarantee about the validity, accuracy, correctness, reliability, quality, stability, completeness, and timeliness of the technology and information involved in Bitpie services and user certification information.
5.3 You can download the Bitpie platform program and use the blockchain asset wallet service for free. We reserve the right to charge you for the program and/or certain specific services in the future.
5.4 You agree and acknowledge that our company only provides relevant network services. Besides, the cost of relevant devices (like personal computers, mobile phones, and other devices related to internet or mobile network access) and the fees charged by third parties (like telephone and internet charges for internet access, and mobile fees for mobile network usage) should be borne by you.
5.5 You understand that Bitpie does not provide intermediation and pricing services for blockchain asset transactions. Bitpie serves only as a technical service provider and provides technical services to users within the scope allowed by local laws. Bitpie cannot control the quality, safety, or legality of the blockchain assets involved in the transaction, or the ability of all parties to fulfill their obligations under the transaction agreement. You should carefully judge the authenticity, legality, and validity of the related blockchain assets and/or transactions, and bear the responsibility and losses that may arise from it.
5.6 You promise that you understand the related matters of transaction confirmation on the blockchain. We provide transaction accelerator services but do not guarantee to you or any party that the transaction confirmation can definitely be completed within a specific time limit. We do not assume any compensation responsibility or joint obligation if you or any party suffers losses due to the confirmation time limit.
5.7 By using and agreeing to this agreement, you are considered to understand and master the related matters of blockchain assets and HD wallets. If you still do not understand or are unsure about such matters, you should immediately stop using Bitpie products. You have the responsibility and obligation to safeguard the security of the assets in your account, and we are not responsible for providing incidental legal responsibility training or implication. If you or your counterpart do not follow this agreement or the operation prompts and rules on the relevant website and APP instruction pages, Bitpie does not guarantee that the operation will be completed smoothly, and Bitpie does not assume compensation responsibility for the damage caused thereby. If the aforementioned situation occurs and the blockchain assets have been credited to your or your trading party’s Bitpie wallet or third-party wallet in advance, you understand the “irreversible” attribute of blockchain operations and the “irrevocable” feature of related transactions, and you and your counterpart will bear the corresponding risk consequences.
5.8 You understand that when you create or import a wallet on Bitpie, your seed phrase, private key, password, and other information are stored only on the current mobile device and not on Bitpie’s servers. If you do not save or backup wallet seed phrases, private keys, and other information, and your mobile device is lost or damaged, your blockchain assets will be lost and Bitpie cannot recover them for you. You must bear the corresponding loss. If you leak your seed phrase, private key, password, etc. during exporting, saving, or backing up, or if the device or server where you store or backup this information is hacked or controlled, your blockchain assets will be lost. Bitpie cannot recover them for you, and you must bear the corresponding loss.
5.9 Unless required by law or regulations, or in the following circumstances, Bitpie has no obligation to review all user information data, blockchain asset information, transaction behavior, and other matters related to the transaction:
5.10 You agree and accept that Bitpie platform has the right to provide differentiated services due to reasonable reasons at different times, different regions, or different network sources. Bitpie does not guarantee that users can always get platform responses in all periods, all regions, or all network sources. Bitpie is not liable for the limited services or losses caused by this.
5.11 You understand and agree that Bitpie is not liable for any damage caused by any of the following situations, including but not limited to profits, goodwill, use, data, or other intangible losses (regardless of whether Bitpie has been informed of the possibility of such compensation):
5.12 As more and more fraudsters try various ways to deceive unsuspecting victims of digital assets, please verify the SSL certificate every time you visit our domain. This “Service Agreement” (defined below) only applies to domain stations with valid SSL certificates issued by Google Trust Services LLC: https://bitpie.com. Before downloading, clicking, or interacting in any way with the website you are visiting, please ensure the authenticity of the SSL certificate. To avoid doubt, we cannot control the content, privacy policies, or behaviors of any third-party websites or services, nor do we take any responsibility for them. We are not responsible or liable, directly or indirectly, for any damage or loss caused or claimed to be caused by the use or reliance on any such content, goods, or services on or through any such website or service.
5.13 You agree that the functions provided by the Bitpie (Bitpie) platform are subject to the relevant laws, regulations, and administrative regulations of the user’s country. When there is a conflict with the functionality and regulations of this product, the local laws, regulations, and administrative regulations should be the highest guideline. Any direct or indirect violation of local laws, regulations, and administrative regulations through the Bitpie (Bitpie) platform service, the consequences should be borne by the user. If necessary, our company can provide relevant materials to the relevant departments as evidence.
6.1 You understand and agree that our company needs to periodically or irregularly inspect or maintain the platform (such as internet websites, mobile networks, etc.) or related equipment that provides network services, and the internet connection capability is limited by the stability of the global network, technical status, user location and the network used, power supply, government regulation, computer viruses, hacker attacks, and other existing uncertainties. If such situations cause service interruption, our company does not need to bear any responsibility for this, and except in special circumstances, there is no need to notify in advance.
6.2 If any of the following situations occur, our company has the right to interrupt or terminate the provision of all or part of the network services under this agreement to you at any time without having to bear any responsibility to you or any third party:
6.3 If the behavior or mode of any user registering an account or using the Bitpie (Bitpie) platform violates laws and regulations or related national policy requirements, or infringes on the legal rights and interests of any third party, our company has the right to prohibit the user from continuing to use that account or stop the user from continuing to use the Bitpie (Bitpie) platform, or according to relevant laws or government orders, provide relevant information to the government and related law enforcement agencies.
The Bitpie software is developed by the Bitpie Wallet Team. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of the Bitpie software, as well as all related information content, except for software or technology involving third-party authorization, are owned by the Bitpie Wallet Team.
Without the written consent of our company, users are not allowed to implement, use, transfer or license any third party to implement, use, transfer the aforementioned intellectual property rights for any profit or non-profit purposes. Our company reserves the right to pursue the above unauthorized behaviors.
All products and services of Bitpie may contain links to third-party websites (hereinafter referred to as “linked sites”). “Linked sites” are not controlled by our company, and our company is not responsible for any content of any “linked site”, including but not limited to any links contained in the “linked site”, or any changes or updates to the “linked site”. Our company is not responsible for network transmissions or other forms of transmission received by “linked sites”.
All products and services of Bitpie may contain links to third-party APIs or DAPP services. Third-party APIs or DAPP services are not controlled by our company. For any service performed through a third-party API or DAPP, when you use the third-party API or DApp services integrated with Bitpie, please carefully read this agreement and APP prompts, understand the transaction or service objects and product information, and take action after carefully assessing the risks. All your operations on third-party APIs or DAPPs are your personal behaviors. A binding contractual relationship is established between you and your counterpart, which is unrelated to Bitpie. Bitpie does not assume any responsibility for all risks, liabilities, losses, and costs arising from your transaction behaviors.
This agreement you established with us is an indefinite term agreement, and we have the right to terminate the contract at any time and it will take effect immediately if you commit the following acts:
‘Force majeure’ refers to an event that Bitpie cannot control, foresee, or even if foreseen, cannot avoid, and this event hinders, affects, or delays Bitpie from fulfilling its all or part of the obligations according to the terms of this agreement. This event includes but is not limited to government actions, natural disasters, wars, strikes, hacker attacks, computer viruses, network failures, etc. Force majeure may lead to unfavorable consequences such as the inability to access the Bitpie website and mobile clients, slow access speed, loss of stored data, leakage of user personal information, etc.
Within the scope permitted by law, regardless of the circumstances, Bitpie does not assume any responsibility for the inability to serve or delay in service caused by force majeure factors, such as maintenance of information network equipment, failure of information network connections, failures of computers, communications or other systems, power failures, strikes, labor disputes, riots, insurrections, disturbances, insufficient productivity or production materials, fires, floods, storms, explosions, wars, government actions, orders of judicial administrative organs, other force majeure or inaction by third parties, and the losses suffered by users as a result.
If one or more terms of this ‘User Service Agreement’ are determined to be invalid, in this case, the validity and implementation of other terms are not affected, and we can decide whether to continue to fulfill these other terms. We reserve the right to modify or replace the terms of this ‘User Service Agreement’ at any time, or to change, suspend, or terminate the service or application (including but not limited to the availability of any features, databases, or content). At that time, we only need to post a notice on the website and/or application software platform or send a notice. If you do not agree with the changes we have made to this ‘User Service Agreement’, you have the right to stop using the service. If you continue to use the service, it will be regarded as your acceptance of the changes we have made to this ‘User Service Agreement’.
Any translated version of this agreement (if any) is provided for the convenience of users and is not intended to modify the terms of this agreement. If there is a conflict between the Chinese version of this agreement and the non-Chinese version, the Chinese version shall prevail.
For issues not covered in this Agreement, you are required to comply with the announcements and relevant rules updated by Bitpie from time to time.
